These Terms apply to visitors, prospective and existing purchasers, tenants, sellers, landlords and other users. A separate signed mandate, agency agreement, reservation, lease, deed or other transaction document may also apply. If there is a conflict, the signed transaction-specific document governs that transaction to the extent of the conflict.

2. Website information is not an offer
Property listings, photographs, floor areas, maps, distances, descriptions, prices and other website content are general information and invitations to enquire. They do not constitute a contractual offer, representation, warranty, valuation, survey, legal advice, tax advice, financial advice or guarantee.
No property is reserved, rented or sold merely because you submit an enquiry, request a viewing, express interest or receive a message from us. A transaction is subject to availability, verification, agreement between the relevant parties, any required checks, payment and execution of binding documents.
3. Listings, availability and accuracy
We take reasonable care when preparing listings, but information is often supplied by owners, landlords, sellers, developers or other third parties. Details may change, and errors or omissions may occur. Prices may exclude deposits, agency fees, taxes, utilities, syndic charges, notarial costs or other expenses unless expressly stated.
You must independently verify matters important to your decision, including legal title, permitted use, boundaries, measurements, condition, inventory, planning status, internet availability, neighbourhood conditions, school access, residency eligibility, taxes and total transaction costs. Photographs may use wide-angle lenses, may show staging, and may not depict the property’s current condition.
We may change, correct, suspend or withdraw any listing without notice. We do not promise that a property shown as available remains available when you enquire.
4. Our role as agent
Unless we expressly agree otherwise in writing, we act as an intermediary and are not the property owner, landlord, seller, purchaser or tenant. We may act for and be paid by a landlord, owner, seller, purchaser, tenant or more than one participant where lawfully disclosed and agreed. Our authority is limited to the relevant instruction or mandate.
Statements by an employee or agent bind us only where that person has actual authority and the statement is confirmed in an appropriate written agreement. You should obtain independent professional advice where appropriate.
5. Enquiries, matching and communications
When you tell us your requirements, we may use them to suggest properties and manage follow-up. A suggested property is not a recommendation that it is legally, financially or physically suitable. You remain responsible for your decision.
You agree that we may respond through the contact channel you use or provide, including telephone, email or WhatsApp. Message delivery and security can depend on third-party networks. Marketing communications are governed by your preferences and our Privacy Policy; you may opt out at any time.
6. Viewings and property access
Viewings are subject to confirmation and may be changed or cancelled. You must follow reasonable instructions from our team, the occupier and the property owner; supervise accompanying children; avoid disturbing occupants or neighbours; and not photograph, record, access closed areas or handle possessions without permission.
You are responsible for injury or damage caused by your deliberate, reckless or negligent conduct during a viewing. Tell us in advance about accessibility requirements. Do not attend if doing so would create an unreasonable health or safety risk.
7. Offers, deposits and payments
An offer is not binding on an owner, seller or landlord until accepted in the legally required manner and all applicable documents are concluded. We may communicate offers and counteroffers but do not guarantee acceptance.
Never send money solely on the basis of an unexpected message or changed bank details. Verify payment instructions directly with us through a known telephone number before transferring funds. Payment terms, refundability and stakeholder arrangements are governed by the applicable written transaction documents and law. We are not responsible for payments made to an unauthorised third party or account where you did not reasonably verify altered instructions.
8. User responsibilities
You agree to provide accurate, current information and to use the website lawfully. You must not:
- misrepresent your identity, authority, financial position or intentions;
- use listing information to bypass an introduced agent or contact an occupier improperly;
- scrape, harvest, copy or systematically extract listings or personal data;
- upload malware, probe security, overload the service or seek unauthorised access;
- use the website for fraud, discrimination, harassment, unlawful marketing or another illegal purpose;
- copy or republish content except as expressly permitted below.
We may restrict access or stop responding where we reasonably suspect misuse, fraud, threats, unlawful conduct or risk to a person or property.
9. Intellectual property
The website design, branding, text, photographs, graphics, databases and other content are owned by or licensed to iLand Homes and protected by applicable intellectual-property laws. You may view and make a limited personal copy of a listing for your genuine property search. You may not commercially reuse, alter, remove notices from, republish, distribute or create a database from our content without prior written permission.
Property owners who provide media or listing material confirm they have the rights and permissions needed for us to use it for the agreed marketing purpose.
10. Third-party services and links
The website may link to maps, portals, social media, WhatsApp, payment services or professional advisers. Third parties operate independently under their own terms. A link or introduction does not guarantee or endorse their availability, performance or advice. We are not responsible for external services outside our control.
11. Website availability and security
We aim to keep the website useful and secure but do not guarantee continuous, error-free or virus-free access. We may update, suspend or withdraw any part of it for maintenance, security or business reasons. You are responsible for suitable devices, internet access, backups and reasonable security precautions.
12. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation and any mandatory rights under Mauritian law.
Subject to that qualification, iLand Homes is not liable for loss arising solely from reliance on unverified listing particulars; a third party’s acts, omissions or insolvency; a property’s withdrawal or another party’s refusal to proceed; an external website or communications network; or events beyond our reasonable control. We are not liable for indirect or consequential loss, loss of opportunity, profit, revenue, goodwill or anticipated savings arising from website use.
Any liability arising from professional agency services will also be governed by the relevant signed agreement. Nothing here removes a duty expressly undertaken by us in that agreement.
13. Privacy
Our Privacy Policy explains how we collect, use, disclose and protect personal data. By providing another person’s information, you confirm that you are authorised to do so and have informed them appropriately.
14. Changes
We may update these Terms to reflect changes in the website, our services or applicable law. The current version and effective date will appear here. Changes apply from publication and do not retrospectively alter an already signed transaction agreement.
15. Severability and no waiver
If a provision is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions continue in effect. A delay in exercising a right is not a waiver of that right.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Mauritius. Subject to any mandatory consumer right or agreed dispute process, the courts of Mauritius have jurisdiction. Before starting formal proceedings, we encourage you to contact us so the matter can be considered promptly.
